§ 1. DEFINITIONS AND SCOPE

1.1 Terms and Definitions

The following definitions are used in these Terms and Conditions:

A natural person entering into a contract with the Seller for purposes unrelated to their business activity (Article 22¹ of the Civil Code)

Business Entity

A natural person, legal entity, or organizational unit entering into a contract in connection with their business or professional activity

Mystery Box

A package containing products of unknown content, valued on an "as seen - as purchased" basis

Mystery Pallet

A logistics pallet containing products of unknown content, intended primarily for business buyers (B2B) or consumers purchasing in bulk

Mixed Goods

A box or pallet containing randomly selected products from different categories (A, B, C) without guarantee of homogeneity

Sorted Goods

A box or pallet containing products from a selected category or industry (e.g., electronics, household appliances, tools, garden, kitchen)

Category A

New, unused goods, typically in original manufacturer packaging, without visible damage, ready for direct resale

Category B

Used, display, or returned goods, technically functional, may show minor signs of use, packaging may be damaged

Category C

Damaged goods, incomplete items, requiring repairs, intended for spare parts or repair

Complaint

A claim arising from non-conformity of goods with the contract or product defects

Business Days

Monday through Friday, excluding statutory holidays in Poland

Without Delay

As soon as practicably possible, no longer than 3 business days

1.2 Subject Matter of Terms and Conditions

These Terms and Conditions establish the conditions for the sale of Mystery Boxes and Mystery Pallets containing products in various categories, sold on an "as seen - as purchased" (as is/where is) basis, with limited return options.

These Terms and Conditions apply to both consumers and business entities making purchases in the Store.

§ 3. APPLICABILITY OF TERMS AND CONDITIONS

3.1 Scope of Application

  1. These Terms and Conditions apply to all sales of Mystery Boxes and Mystery Pallets offered in the Store.
  2. These Terms and Conditions are available free of charge on the Seller's website and sent with each order.
  3. Conclusion of a contract constitutes acceptance of all provisions of these Terms and Conditions without exception.
  4. These Terms and Conditions apply to both consumers and business entities, with exceptions specified in § 10.

3.2 Modification of Terms and Conditions

  1. The Seller reserves the right to unilaterally modify the provisions of these Terms and Conditions.
  2. Changes become effective on the date of publication on the Seller's website.
  3. Changes apply to all contracts concluded after the date the changes take effect.
  4. By accepting subsequent orders, the Buyer accepts the current version of these Terms and Conditions.

§ 4. CHARACTERISTICS OF MYSTERY BOX AND MYSTERY PALLETS

4.1 Essence of Mystery Box Sales

  1. Principle of Unknown Content: A Mystery Box is a product whose exact contents are unknown to the Buyer at the time of contract conclusion. The purchase incorporates an element of uncertainty and surprise.
  2. Content Value Guarantee: The Seller guarantees that the average value of goods contained in a Mystery Box, calculated according to the Seller's regular sales prices, amounts to a minimum of 100% of the Box purchase price.
  3. Exceptions to Value Guarantee:
  • For Category C Mystery Boxes, the minimum guarantee is 70% of the Box purchase price
  • For Mixed category A+B+C Boxes, the minimum guarantee is 80% of the Box purchase price
  • The guarantee applies to the total set of all products, not individual items

Option to Select Preferred Category: The Buyer may choose:

  • Mixed Box (Mix A+B+C)
  • Category A Box (new, unused)
  • Category B Box (used, display)
  • Category C Box (damaged, requiring repair)
  • Sorted Box (specific product category)

4.2 Characteristics of B2B Mystery Pallets

  1. Intended Purpose: Mystery Pallets are intended primarily for business buyers (resellers, wholesalers, distributors).
  2. Wholesale Sale: Pallets are sold on an "as seen - as purchased" (as is/where is) basis, without the possibility of inspecting the exact contents before purchase.
  3. Pallet Contents:
  • A pallet contains between 20 to 80+ units depending on type and dimensions
  • A pallet may contain goods from one category or Mix (A+B+C)
  • A pallet may contain goods from one industry (sorted) or various industries (mixed)

Pallet Categories:

  • Mix A+B+C Pallet (unspecified composition)
  • Mix A+B Pallet (without Category C)
  • Category A Pallet (new goods)
  • Sorted Pallet (electronics, household appliances, tools, garden, kitchen, etc.)

4.3 Exclusions from Possible Mystery Box/Pallet Purchases

The following product categories CANNOT be included in Mystery Boxes/Pallets:

    • Dangerous or illegal goods
    • Food products and pharmaceuticals (except factory original packaging)
    • Open or tested perfumes and cosmetics
    • Hygiene products (toothbrushes, masks, intimate articles)
    • Biologically hazardous materials
    • Collectible items requiring certification
    • Original SIM cards with data

§ 5. PRODUCT CATEGORIZATION

5.1 Category A - New Goods

Definition: Goods that are unused, in original, unopened manufacturer packaging, without visible damage.

Characteristics:

    • New, never previously sold or used
    • Original factory packaging, unopened
    • Complete with all accessories and instructions
    • No signs of use, damage, discoloration, or scratches
    • All functional elements (if verifiable without damaging packaging)

Examples: Electronic devices in factory packaging, new furniture, clothing with tags, new books, etc.

5.2 Category B - Used/Display Goods

Definition: Previously used, sold, or displayed goods, yet technically functional.

Characteristics:

    • Goods may show minor signs of use (scratches, dents, discoloration)
    • Packaging may be damaged, creased, new, or missing
    • Original accessories or instructions may be missing
    • Goods are in working order (electronic items function properly)
    • May include consumer returns, display items, cheap imports, or end-of-series stock

Examples: Used but functional electronics, display furniture, worn clothing, consumer returns, etc.

5.3 Category C - Damaged/Repair Goods

Definition: Damaged, incomplete, or goods requiring repairs.

Characteristics:

    • Goods may show significant damage (cracks, broken screens, non-functionality)
    • Parts or accessories are missing
    • Require repair or servicing
    • May be intended for spare parts
    • Value depends on repair feasibility and restoration to functionality
    • WARNING: Seller does not guarantee functionality

Examples: Damaged electronics, furniture with cracks, torn clothing, etc.


§ 6. PURCHASE PROCESS AND CONCLUSION OF CONTRACT

6.1 Conditions for Placing an Order

  1. To place an order, the Buyer must:
  • Be of legal age (minimum 18 years)
  • Provide correct personal data and delivery address
  • Accept the provisions of these Terms and Conditions
  • Select the type of Mystery Box/Pallet (Mix, Category, sorted)

An order may be placed through:

  • The Store's e-commerce platform
  • Email to sales@chinczyk.com
  • Telephone at +48 609 720 842 during business hours

6.2 Conclusion of Contract

  1. Moment of Contract Conclusion: The sales contract is concluded at:
  • The Buyer's order confirmation (click "I order")
  • Receipt of confirmation email from the Seller
  • In any case no later than the moment goods are dispatched

Order Confirmation: The Seller will send the Buyer an email confirmation containing:

  • Order number
  • Type of Mystery Box/Pallet
  • Price and payment terms
  • Estimated dispatch date
  • Link to these Terms and Conditions

Contract Modification: After contract conclusion, the Buyer may request order cancellation; however:

  • If goods have not yet been packed - cancellation without cost
  • If goods are already packed - cancellation with 15% fee (covering packing and handling costs)
  • If goods have been dispatched - cancellation not possible; Buyer may use withdrawal right (§ 10)

6.3 Languages of Communication

Communication regarding the contract and these Terms and Conditions is conducted in Polish. Correspondence in other languages may be available upon Buyer request; however, the regulatory jurisdiction remains Polish.


§ 7. PRODUCT PRICES

7.1 Price List

  1. Mystery Box and Mystery Pallet prices are stated in Polish zloty (PLN) including VAT.
  2. Prices may be changed by the Seller at any time.
  3. Price change does not apply to already confirmed orders - the price from the moment of confirmation applies to such orders.

7.2 Additional Costs

  1. Delivery: Delivery costs are itemized before finalizing the order.
  2. Optional Services:
  • Parcel insurance (if selected)
  • Cash on delivery (if available)
  • Parcel locker delivery (delivery discount)

No hidden fees - all costs are clearly indicated before payment.

7.3 Promotions and Discounts

  1. Promotions are announced during their validity period.
  2. Promotions do not combine with each other (the highest available promotion applies).
  3. Discount coupons may be entered in the "Promo Code" field before order confirmation.
  4. The Seller reserves the right to cancel orders made under promotions in cases of fraud or misuse.

§ 8. PAYMENT METHODS

8.1 Available Methods

The Buyer may make payment for the order through:

  1. Credit/Debit Cards: Visa, Mastercard, American Express
  2. E-wallets: PayPal, Apple Pay, Google Pay (if available)
  3. Online Transfers: Przelewy24 (P24), Inteligo, Santander, Bank Millennium
  4. Direct Bank Transfer: To the Seller's account (details provided after order approval)
  5. Cash on Delivery: Upon delivery (additional handling fee)

8.2 Payment Security

  1. All transactions are encrypted (HTTPS/TLS 1.3)
  2. Card data is not stored on the Seller's servers
  3. Payment processing is conducted through certified processors
  4. The Seller has no access to the Buyer's full credit card data

8.3 Payment Confirmation

  1. After payment is made, the Buyer will receive confirmation via email.
  2. If payment is not confirmed within 24 hours, the order will be cancelled.
  3. Refunds will be credited to the same account/card from which payment was made, within 3-5 business days.

§ 9. ORDER FULFILLMENT AND DELIVERY

9.1 Fulfillment Time

  1. Mystery Box: Fulfillment within 1-3 business days from payment confirmation
  2. Mystery Pallets: Fulfillment within 2-5 business days from payment confirmation
  3. The Seller does not guarantee faster fulfillment - timeframes are approximate

9.2 Packaging and Shipment

  1. Mystery Boxes will be packed in protective packaging (cardboard, bubble wrap)
  2. Mystery Pallets will be delivered on logistics pallets secured with string
  3. Each shipment will include a delivery note with tracking number
  4. The tracking number will be available in the "Orders" section or sent via email

9.3 Delivery

  1. Carrier: Delivery will be executed by the selected logistics operator (DPD, InPost, DHL, GLS, Parcel Locker, etc.)
  2. Delivery Costs: Indicated during ordering, no additional delivery charges
  3. Delivery Timeframe:
  • Domestic deliveries: 1-3 business days (depending on availability and location)
  • International deliveries: 3-14 business days (depending on destination country)

Insurance: Standard parcels insured; option for additional insurance available for fee

9.4 Transportation Risks

  1. Seller Responsibility: The Seller is responsible for goods until signed for by the Buyer or authorized person.
  2. Damage During Delivery: The Buyer should report damage immediately (upon delivery or within 2 days):
  • Directly to the courier (note on delivery document)
  • By email to returns@chinczyk.com with damage photos

Lost Shipment: In case of lost shipment, the Seller will refund payment for goods and delivery. Claims procedure applies.

9.5 Delivery Refusal

The Buyer has the right to refuse delivery within 48 hours of receiving notice from the courier. In such case:

    • The goods are returned to the Seller
    • Return costs are borne by the Buyer (unless caused by Seller's fault)
    • Refund of goods payment follows verification of shipment condition

§ 10. RIGHT OF WITHDRAWAL - EXCEPTIONS

10.1 Application of Withdrawal Right

  1. Consumers have the right to withdraw from the Mystery Box sales contract within 14 calendar days from the date of receipt of goods, without providing reasons (Article 27 of the Consumer Protection Act).
  2. HOWEVER - with respect to Mystery Boxes and Mystery Pallets, important exceptions apply as specified below.

10.2 Exceptions to Withdrawal Right

The right to withdraw from the contract DOES NOT APPLY (Article 38 Section 3 of the Consumer Protection Act) in the following cases:

a) Goods Delivered in Opened Condition

Rationale: The essence of Mystery Box lies in unknown content. Opening the packaging violates this essence and prevents resale to another consumer.

  1. If goods are opened or unpacked, the withdrawal right expires
  2. Definition of unpacking:
  • Removal of packaging tape/seal
  • Opening of Mystery Box cardboard box
  • Partial removal of contents
  • Any action changing the condition of packaging

Exception to Exception: If opening was necessary for:

  • Checking whether contents were damaged upon delivery
  • Verifying that goods conform to description
  • Separating defective goods upon delivery

b) Personalized or Custom-Made Goods

If a Mystery Box contains personalized, engraved, or specially prepared goods at the Buyer's request, the withdrawal right expires.

c) Goods Subject to Rapid Deterioration

Where a Mystery Box contains goods subject to rapid deterioration or with expiration dates, the withdrawal right expires if there was access to factory packaging.

d) Category C - Damaged Goods

For Mystery Boxes from Category C (damaged goods, for repair), the withdrawal period is 7 days (instead of the standard 14 days), due to the specific nature of these goods.

e) Business Entities (B2B)

Business entities purchasing Mystery Pallets in a business capacity DO NOT HAVE THE RIGHT TO WITHDRAW (Article 27 Section 2 of the Consumer Protection Act). The warranty right applies (§ 11).

10.3 Procedure for Withdrawal from Contract

If a Buyer (consumer) decides to exercise the withdrawal right, they should:

  1. Submit Withdrawal Statement:
  • Email to returns@chinczyk.com with order number
  • Personally deliver statement to Seller's address (ul. Leśna 10A, 74-105 Pniewo)
  • Use form available on Store website (if available)

Timeframe: Statement must be sent within 14 days of receipt of goods

Form of Statement: Statement should contain:

  • Order number
  • Date of receipt of goods
  • Reason for withdrawal (optional)
  • Signature (if paper form)

10.4 Goods Return

  1. Return Obligation: After submitting withdrawal statement, the Buyer must without delay, no later than 14 days return goods to the Seller.
  2. Condition of Goods: Goods must be returned:
  • In original packaging (if undamaged)
  • Unbroken, complete
  • Without signs of use (except for normal inspection)

Return Address: Goods should be returned to:

  • "FIRMA HANDLOWA - MEBLE" SYLWIA NIEMCZYK
  • ul. Leśna 10A, 74-105 Pniewo, Poland
  • With order number on parcel

Return Costs:

  • Return costs borne by Buyer (standard e-commerce practice)
  • If return results from Seller's fault (system error, incorrect goods) - Seller covers costs
  • Insured return shipment recommended

10.5 Refund

  1. Refund Timeframe: The Seller will refund payment within 14 days of receiving withdrawal statement, but no later than 14 days after receipt of returned goods.
  2. Refund Amount:
  • Full price of goods + delivery cost (if not resulting from Buyer's fault)
  • Reduced by damage (if goods show signs of use)
  • No refund of return costs (unless resulting from Seller's fault)

Refund Method:

  • Refund to same account/card from which payment was made
  • Refund via email in case of transfer or cash payment
  • Timeframe: 3-5 business days

10.6 Reduction of Refund for Damage

The Seller has the right to reduce the refund by the value of damage in the following cases:

  1. Damage from Use: If goods were broken, scratched, or destroyed
  2. Missing Elements: If parts of Box contents are missing
  3. Change of Condition: If goods are in different condition than upon delivery

Reduction may be from 10% to 100% of refund depending on extent of damage.


§ 11. CLAIMS AND WARRANTY

11.1 Non-Conformity of Goods with Contract

The Buyer has the right to make a claim (report non-conformity) in the following cases:

  1. Goods Do Not Conform to Description:
  • Mystery Box was supposed to contain Category A, but contains B/C
  • Sorted Mystery Box contains products from different category than ordered
  • Pallet contains goods from different category than ordered

Goods Damaged Upon Delivery:

  • Broken screens, damaged parts
  • Packaging completely destroyed (not just shipping damage)
  • Missing elements due to damage

Goods Not Functioning (if electronic item):

  • Category A/B electronics should be functional
  • Category C electronics - no functionality guarantee (always for repair)

Manufacturing Defect:

  • Visible manufacturing defects
  • Missing parts due to manufacturer error

11.2 Claim Reporting Period

  1. Consumer: Claim should be reported within 14 days of receipt of goods
  2. Business Entity: Claim should be reported within 30 days of receipt of goods

11.3 Claims Procedure

To file a claim, the Buyer should:

  1. Prepare Documentation:
  • Order number
  • Photos of damage or goods not conforming to description
  • Detailed description of problem
  • Proof of payment (copy of receipt/invoice)

Submit Claim:

Form: Claim should contain:

  • Buyer's contact information
  • Order number
  • Description of problem
  • Supporting photos

11.4 Claims Resolution

  1. Timeframe: The Seller will resolve the claim within 14 days of receipt
  2. Possible Resolutions:
  • Goods Exchange: Exchange for goods of similar value (if available)
  • Money Refund: Refund of full payment amount
  • Repair: If damage can be repaired (mainly Category B/C)
  • Claims Rejection: If problem does not result from Seller's fault

Communication: Seller will inform of resolution via email

11.5 Manufacturer Warranty

  1. Manufacturer warranty (if specified) applies to conditions specified by manufacturer
  2. Warranty does not apply to Mystery Box as such, but individual products within may be covered
  3. Warranty claims should be directed to the manufacturer, not the Seller

11.6 Warranty for Defects

For Consumers:

    • Consumer has warranty right for defects existing at time of goods delivery
    • Defects must be disclosed within 2 years from delivery (Article 556 Civil Code)
    • Warranty includes: exchange, repair, or price reduction

For Business Entities:

    • Warranty right is limited - trade law applies
    • Timeframe: 12 months from delivery
    • Claims must be submitted in writing

11.7 Warranty Exceptions

Warranty does NOT cover:

  1. Category C: Damaged goods for repair - sold "as seen, as purchased"
  2. Signs of Use: Minor damage resulting from normal use
  3. Accidental Damage: Damage caused by the Buyer
  4. Change of Condition: If goods were unpacked and used
  5. Goods Sold with Noted Defects: If defect was known and mentioned

11.8 No Guarantee on Contents

The Seller DOES NOT GUARANTEE:

    • Exact contents of Mystery Box (essence of product - unknownness)
    • Completeness of all accessories (may be missing upon delivery)
    • Conformity with individual Buyer preferences
    • Functionality of Category C goods
    • Repair feasibility of Category C goods
    • Conformity with expectations - Mystery Box is an unpredictable product

§ 12. PERSONAL DATA AND PRIVACY PROTECTION

12.1 Data Controller

The data controller of Buyer's personal data is "FIRMA HANDLOWA - MEBLE" SYLWIA NIEMCZYK, ul. Leśna 10A, 74-105 Pniewo, NIP 8581079288.

12.2 Data Collected

During ordering, the following data is collected:

    • Name and surname
    • Email address
    • Phone number
    • Delivery address
    • Order history
    • Payment information

12.3 Processing Purposes

Data is processed for purposes of:

    • Contract performance (Article 6 Section 1 lit. b GDPR)
    • Accounting and tax purposes (Article 6 Section 1 lit. c GDPR)
    • Communication with Buyer (Article 6 Section 1 lit. b GDPR)
    • Sending marketing offers (if consent provided - Article 6 Section 1 lit. a GDPR)
    • Dispute resolution (Article 6 Section 1 lit. f GDPR - legitimate interest)

12.4 Data Retention Period

  1. Data for Business Purposes: Retained during contract performance + 5 years (statute of limitations period)
  2. Data for Tax Purposes: Retained for 6 years (VAT Act requirement)
  3. Data Based on Consent: Retained until consent is withdrawn by Buyer
  4. Data in Disputes: Retained during dispute proceedings + 3 years after conclusion

12.5 Data Recipients

Data may be transferred to the following recipients:

    • Couriers delivering goods
    • Banks and payment processors
    • Public authorities (if required by law)
    • Attorneys in case of disputes
    • Accounting services (for tax purposes)

12.6 Buyer Rights

The Buyer has the right to:

    • Access their data
    • Correct data
    • Delete data (right to be forgotten)
    • Restrict processing
    • Data portability
    • Withdraw consent for processing

Request should be sent via email to admin@chinczyk.com with providing PESEL number or identification data.

12.7 Cookie Policy

The Store uses cookies for:

    • Remembering Buyer preferences
    • Tracking site traffic (Google Analytics)
    • Personalizing ads (retargeting)

Buyers may disable cookies in browser settings.

12.8 Complaints to UODO

In case of violation of rights regarding data protection, the Buyer has the right to file complaint with the President of the Office for Personal Data Protection (UODO) at:

    • ul. Stawki 2, 00-193 Warsaw, Poland

§ 13. LIABILITY AND LIMITATIONS

13.1 Limitation of Seller's Liability

  1. Limitation to Price of Goods: The Seller is liable only for the value of Mystery Box/Pallet, not for:
  • Lost profits
  • Indirect losses
  • Lost revenues
  • Buyer's disappointment or frustration

No Liability For:

  • Unknown content (essence of Mystery Box)
  • Personal preferences of Buyer
  • Product unavailability in other stores
  • Market price changes

13.2 Force Majeure

The Seller is NOT liable for:

    • Natural disasters
    • War, civil unrest
    • Epidemics, pandemics
    • Supply disruptions
    • System failures outside Seller's control
    • Transport strikes

13.3 Buyer Responsibility

The Buyer is responsible for:

    • Accuracy of provided data (address, email, phone number)
    • Account access security
    • Reporting unauthorized transactions immediately
    • Returning goods within timeframe and conditions specified

§ 14. DISPUTE RESOLUTION

14.1 Mediation

  1. Before proceeding to court, we encourage mediation.
  2. Mediation proposal is sent via email to returns@chinczyk.com with problem description.
  3. The Seller will respond within 7 business days.

14.2 Arbitration Court

Disputes may be resolved by an Arbitration Court (if both parties consent).

14.3 Legal Action

  1. Consumer: Has the right to pursue matter before court of competent jurisdiction for Buyer's residence
  2. Business Entity: B2B disputes are resolved before court competent for Seller's headquarters (Pniewo)

14.4 Applicable Law

  1. All contracts with Buyers are governed by Polish law
  2. Disputes are resolved by Polish courts
  3. Language of proceedings: Polish

§ 15. FINAL PROVISIONS

15.1 Modification of Terms and Conditions

  1. The Seller has the right to modify these Terms and Conditions at any time.
  2. Changes become effective on the date of publication on the website.
  3. Changes apply to contracts concluded after the modification.
  4. If modification is substantially unfavorable to Buyer, notification will be sent via email.

15.2 Validity of Provisions

If any provision of these Terms and Conditions is found invalid, remaining provisions remain in force.

15.3 No Waiver of Rights

The Seller's failure to exercise any rights arising from these Terms and Conditions does not constitute waiver of such right.

15.4 Combination with Other Terms and Conditions

  1. These Mystery Box/Pallet Terms and Conditions are combined with:
