§ 1. GENERAL PROVISIONS
1.1 Scope of Regulations
- These Regulations establish the rules for participation in online auctions organized by "FIRMA HANDLOWA - MEBLE" SYLWIA NIEMCZYK, NIP: 8581079288, REGON: 810547668, headquartered at ul. Leśna 10A, 74-105 Pniewo ("Organizer", "Seller").
- Auctions are conducted exclusively online through:
- Organizer's sales platform (online store at chinczyk.com)
- External auction platforms (e.g., Allegro, other auction services - if indicated in auction description)
Auction participants may be:
- Consumers (natural persons making purchases unrelated to business or professional activity - pursuant to Article 22¹ of the Civil Code)
- Business entities (B2B), including resellers, shops, trading companies, distributors
1.2 Application of Regulations
- Participation in an auction is equivalent to acceptance of these Regulations.
- When using an external auction platform, the regulations of that platform also apply. In case of conflict - the more protective provisions for the participant take precedence.
- Auction regulations form an integral part of the sales contract concluded as a result of an auction.
1.3 Hierarchy of Documents
In matters not regulated by the Auction Regulations, the following apply in order:
- Online Auction Regulations (this document)
- Mystery Box Regulations (if the auction item is a Mystery Box/Pallet)
- Online Shop Regulations
- Civil Code (Articles 556-577 on warranty, Article 27 on withdrawal right)
- Law on Consumer Protection (dated December 15, 2023)
- Law on Provision of Services by Electronic Means
- GDPR Regulation (EU 2016/679) - data protection
- Other Polish law provisions
§ 2. DEFINITIONS

§ 3. TYPES OF AUCTION ITEMS
3.1 Items that may be Auctioned
Auction items may include in particular:
- Individual goods: new, used, display, damaged
- Sets of goods: packages, bundles, pallets
- Mystery Box / Mystery Pallets: in Categories A, B, C or in mixes A+B+C (pursuant to Mystery Box Regulations)
- Goods from warehouse inventory: purchases, clearances
- Returned goods: from previous buyers
3.2 Auction Description
The auction description must include at least:
- Type of goods: new, used, damaged, for repair
- Category: A/B/C/mix (if applicable)
- Material defects or missing parts: known to the Organizer
- Approximate market value or information about lack thereof
- Terms of sale:
- whether goods are sold "as is" without technical warranty
- whether the item has limited withdrawal right
Physical condition: photographic description or detailed text
Content information: if applicable to Mystery Box/Pallet
3.3 Mystery Box / Mystery Pallets in Auction
- If the auction item is a Mystery Box or Mystery Pallet:
- contents are wholly or partially undisclosed (pursuant to Mystery Box Regulations § 4)
- descriptions are based on general parameters (category, industry, approximate quantities)
- User accepts an element of randomness and unpredictability
- WITHDRAWAL RIGHT EXCEPTION: pursuant to Mystery Box Regulations § 10.2, withdrawal right is limited or excluded
- Mystery Box in auction is subject to Mystery Box Regulations (minimum value guarantees: 100% for A, 80% for mix A+B+C, 70% for C)
3.4 Exclusions from Auctions
Cannot be auctioned:
- Dangerous or illegal goods
- Food products and pharmaceuticals (except in manufacturer's original packaging)
- Opened or tested perfumes and cosmetics
- Hygiene articles (toothbrushes, masks, intimate items)
- Biologically hazardous materials
- Antique items requiring certification
- Original SIM cards with data
§ 4. CONDITIONS OF PARTICIPATION IN AUCTION
4.1 Formal Requirements
Participation in an auction requires:
- Possession of active account: in Organizer's shop or on external auction platform
- Familiarity with Regulations: and explicit acceptance thereof
- Legal age: minimum 18 years for natural persons
- Full legal capacity: natural persons must be capable of concluding contracts
- Provision of correct information: including correct delivery address and contact details
4.2 Business Entity Statements
- A business entity, when registering an account or participating in an auction, declares that:
- it operates within its business or professional activity
- it possesses all necessary permits and registrations (CEIDG, KRS registration, etc.)
- it accepts stricter complaint procedures and requires VAT invoices
For B2B, additional conditions may apply, including:
- minimum order amount
- requirement to provide invoice details
- payment regulations (e.g., payment terms, late payment penalties)
4.3 Right to Refuse Participation
The Organizer may refuse participation in an auction or block a User's account in case of:
- Material breach of Regulations: particularly non-payment, fraud
- Persistent non-payment of obligations: even one instance
- Provision of false information: about oneself, address, payment ability
- Attempts to manipulate auction results:
- collusion between bidders
- artificial bid inflation (shill bidding)
- creation of fictitious accounts
Engagement in competitive activity: if previous disputes existed
Security threats: fraud, criminal activity
4.4 Account Blocking
- Account blocking is preceded (if possible) by a message to the registered email address.
- The User has the right to appeal the block within 7 days of its implementation.
- The Organizer will consider the appeal within 14 business days.
§ 5. AUCTION PROCEDURE AND SUBMISSION OF BIDS
5.1 Auction Duration
- The auction lasts for the period indicated in its description (start and end date/time).
- Time is measured according to server time (UTC+1 or UTC+2 depending on daylight saving time).
- The User is responsible for synchronizing their clock.
5.2 Submitting Bids
- Bids may be submitted exclusively through the auction system (online bidding).
- A bid submitted by a User is binding and cannot be unilaterally withdrawn except in case of:
- obvious error (e.g., mistake by an order of magnitude - 10 PLN instead of 100 PLN)
- if the User immediately (within 1 hour) reports the error to the Organizer
- final determination rests with the Organizer
The auction system supports:
- Manual bidding: User independently increases the price
- Automatic bidding: User sets maximum amount to which system automatically increases their bid
5.3 Bid Increment (Tick)
- The minimum bid increment (tick) may be specified in the auction description or automatically set by the system.
- Typical increments:
- below 50 PLN: 1-2 PLN
- 50-200 PLN: 2-5 PLN
- 200-1000 PLN: 5-10 PLN
- above 1000 PLN: 10-50 PLN or percentage of price
5.4 Bid Validity
- A bid submitted after the auction end time (according to server time) is invalid.
- Bid must contain amount in whole zloty (without cents) or precise to 1 cent - lack of precision may result in rejection.
- Bid cannot be conditional or qualified with reservations.
5.5 Technical Issues
In case of system failure or other material technical obstacles, the Organizer may:
- Invalidate the auction - neither party is bound
- Extend auction time - automatically by several minutes/hours (depending on cause)
- Repeat the auction - at different time, without costs to participants
- Restore previous bids - if error occurred near end of auction
§ 6. AUCTION COMPLETION AND CONCLUSION OF CONTRACT
6.1 Auction Resolution
- An auction is considered resolved if by the time of its completion at least one valid bid equal to or higher than:
- the starting price, and
- the reserve price (if applicable) has been submitted
If the number of bids is less than required, the auction may be:
- invalidated (without binding either party)
- extended
- repeated
6.2 Winner Selection
- The winner of an auction is the User who submitted the highest valid bid at the moment the system closes.
- In case of equal bids, priority is given to bids submitted earlier.
- Automatic bidding is resolved algorithmically - User need not be online at auction end.
6.3 Conclusion of Sales Contract
The sales contract between the User and the Organizer is concluded:
- At the moment of auction completion - between the User who submitted the highest valid bid and the Organizer, or
- At the moment of using "Buy Now" option - if function is available in given auction
- Contract contains elements:
- description of item (pursuant to Article 556 Civil Code)
- gross price
- payment terms
- delivery terms
- warranty/guarantee conditions
6.4 Confirmation and Communication
- User receives confirmation of auction win / "Buy Now" purchase electronically:
- email message to registration address
- notification in customer panel
- payment/invoice link
Confirmation contains:
- transaction number
- item description
- gross and net price (for B2B)
- estimated delivery value
- payment deadline
6.5 Invalidation of Auction Results
The Organizer may invalidate auction results in case of:
- Material error in description:
- incorrect price by an order of magnitude (e.g., 1 PLN instead of 100 PLN)
- missing essential information about item condition
- error in name or category
System technical error:
- incorrect operation of automatic bidding
- bid duplication
- price calculation errors
Suspicion of User breach of Regulations by User:
- bidder collusion
- shill bidding
- fraud
Unforeseen circumstances (force majeure):
- goods cannot be delivered
- manufacturer recalled product
§ 7. PRICES, TAXES AND DELIVERY COSTS
7.1 Prices
- All prices stated in auction descriptions are gross prices (with VAT) unless explicitly stated otherwise.
- For B2B, Organizer may state prices net + VAT - this will always be clearly marked.
7.2 Value Added Tax (VAT)
- VAT included in gross price is:
- 23% (standard)
- 8% (for selected product categories)
- 0% (for VAT-exempt goods)
The VAT rate will be clearly indicated on the invoice.
7.3 Delivery Costs
- Delivery costs are not included in auction price unless auction description states otherwise.
- Delivery costs are presented to User:
- before final order confirmation after auction win
- may be calculated depending on weight and delivery address
- in any case cannot be a surprise
Example delivery costs:
- Parcel Locker (InPost): 12-25 PLN
- Courier (DPD, DHL, GLS): 15-45 PLN
- Pallet (for B2B): 100-500 PLN (depends on route)
- Personal pickup: 0 PLN
7.4 Invoices for B2B
- For business entities, Organizer issues VAT invoices.
- Invoice details must be correctly entered by User (Tax ID, company name, address).
- Invoice is sent:
- immediately after payment confirmation (within 24 hours)
- electronically to email address indicated in profile
- in paper form upon request (additional cost 5 PLN)
§ 8. PAYMENTS
8.1 Payment Deadline
- User who won an auction must pay the final price plus delivery costs within the deadline indicated by the Organizer.
- Standard deadlines:
- Consumers: 2-5 business days
- Business entities: 14-30 days (may be negotiated for regular partners)
Exact deadline is indicated in order confirmation.
8.2 Available Payment Methods
Available payment methods are specified in shop and external auction platform, including:
- Online transfers: Przelewy24 (P24), Inteligo, Santander, Bank Millennium
- Credit/debit cards: Visa, Mastercard, American Express
- E-wallets: PayPal, Apple Pay, Google Pay (if available)
- Traditional bank transfer: to Organizer's account
- Cash on Delivery: upon delivery (if available - additional fee 5 PLN)
- BLIK: if available on platform
8.3 Payment Confirmation
- Payment is automatically confirmed in the system.
- User receives email confirmation.
- In case of confirmation problems, User should immediately contact Organizer.
8.4 Consequences of Non-Payment
Non-payment within the deadline may result in:
- Invalidation of auction results - goods may be re-listed
- Account blocking - temporary or permanent
- Collection fee (if provided in price list):
- consumers: exempt
- business entities: 50-100 PLN for collection procedure
Pursuing compensation claims by Organizer:
- indirect costs
- losses on sales
- statutory interest
§ 9. SHIPPING, PICKUP AND RISK
9.1 Preparation for Shipment
- Goods are shipped after payment is recorded unless parties agreed otherwise.
- Preparation time: typically 1-3 business days.
- Organizer sends tracking message (tracking number) to User's email address.
9.2 Delivery Address
- Organizer ships goods to address provided by User in order.
- User bears full responsibility for accuracy of address information.
- In case of address error - additional costs of correction (parcel relocation) may be charged to User.
9.3 Carrier and Insurance
- Shipment is sent by professional carrier:
- DPD, InPost, DHL, GLS or other
- selection made by Organizer or User
Standard insurance:
- for shipments below 500 PLN - included in delivery cost
- for shipments above 500 PLN - additional insurance for fee (2-5%)
9.4 Transport Risk
- For Consumer: Risk of accidental loss or damage of goods passes to consumer when goods are delivered to consumer or to carrier chosen by consumer.
- For Business Entity: Risk passes when goods are delivered to carrier.
- Pursuant to Civil Code Article 556 CC: Seller (Organizer) is responsible for goods until delivery to Buyer (User).
9.5 Package Inspection
- User should inspect the package upon receipt.
- In case of visible packaging damage, it is recommended to:
- draw up damage report with courier
- take photographic documentation
- do not sign invoice with reservations
Claim registration should occur within 2 business days of delivery.
9.6 Personal Pickup
- If User chose personal pickup:
- must pick up goods within agreed deadline (typically 7 days)
- storage beyond deadline incurs storage fee (5 PLN/day)
- risk passes to User when goods are delivered
§ 10. RIGHT TO WITHDRAW FROM CONTRACT (CONSUMERS)
10.1 General Right to Withdraw
- Consumer who concluded a distance contract as a result of winning an auction generally has the right to withdraw from the contract within 14 days from the day of receiving the goods, without giving reasons.
- This right is exercised primarily in accordance with:
- Article 27 of the Consumer Protection Law
- Articles 27-38 of the law dated December 15, 2023
10.2 EXCEPTIONS - Limitation or Exclusion of Withdrawal Right
The right to withdraw IS EXCLUDED OR LIMITED in case of:
- Mystery Box / Mystery Pallet: pursuant to Mystery Box Regulations § 10.2
- If box was opened - right expires
- For Category C - 7-day period instead of 14
- For mix A+B+C - right may be limited
Goods sold as "as is" (no return):
- Category C (damaged, for repair)
- display goods
- full user liability
- if auction explicitly contains clause "no withdrawal right"
Goods sold in "as is" condition - auction description must clearly state: "no withdrawal right" or "sale without return"
Customized products (personalized, engraved, specially ordered)
Goods subject to rapid deterioration or with short expiration dates (if had access to manufacturer packaging)
10.3 Withdrawal Procedure
To exercise the right to withdraw, consumer must:
- Submit withdrawal statement:
- By email to: returns@chinczyk.com
- Personally deliver to: ul. Leśna 10A, 74-105 Pniewo
- Via form on shop website (if available)
Within 14 days from receiving goods (counted from delivery date)
Statement should contain:
- order/auction number
- date of goods receipt
- reason for withdrawal (optional)
- signature or timestamp entry
10.4 Return of Goods
- After submitting withdrawal statement, consumer must without undue delay return goods to Organizer.
- Deadline: no later than 14 days from statement submission
- Condition of goods:
- in original packaging (if undamaged)
- unbroken, complete
- without visible signs of use (except for normal inspection)
Return address:

- With order number on package
10.5 Return Costs
- Return costs borne by consumer - in accordance with e-commerce practice
- EXCEPTION - Organizer covers costs if:
- error resulted from Organizer's fault (system, wrong goods)
- User explicitly indicated this in statement
Recommended insured return (2-5% of value) - consumer's decision
10.6 Refund
- Refund deadline: within 14 days from receipt of withdrawal statement, but not later than 14 days after receiving returned goods
- Refund amount:
- Full goods price + delivery cost (if not resulting from consumer's fault)
- Reduced by damage (if goods show signs of use)
- No refund of return costs (unless Organizer's fault)
Refund method:
- Same payment method as used for payment (card, transfer, e-wallet)
- By email in case of transfer or cash payment
- Timeframe: 3-5 business days
10.7 Compensation for Use
The Organizer may - in justified cases - charge the consumer reasonable compensation for use of the goods if:
- goods were used beyond normal testing
- condition significantly deteriorated
- lost majority of commercial value
Compensation typically does not exceed 10-20% of price.
§ 11. WARRANTY, CLAIMS AND GUARANTEES
11.1 Warranty (conformity of goods)
- Consumers have warranty rights pursuant to Civil Code (Articles 556-577) and Consumer Protection Law.
- Business entities (B2B) - warranty is limited; commercial law rules apply.
- Warranty includes:
- replacement with goods without defects
- repair
- price reduction
- contract termination
11.2 Claims - Procedure
Claims (physical defects, non-conformity with description) may be submitted:
- Electronically: returns@chinczyk.com or admin@chinczyk.com
- By post to: ul. Leśna 10A, 74-105 Pniewo
- In person: at Organizer's headquarters (arrange by email)
Claims documentation should contain:
- order/auction number
- problem description (detailed)
- photographs of damages (if applicable)
- receipt/invoice (if available)
- request (replacement, repair, refund)
11.3 Time to Submit Claims
- Consumers: submit within 14 days of receiving goods
- if defect appeared later - within 2 years from delivery
Business entities: submit within 30 days of receiving goods
11.4 Goods Sold Without Warranty
Warranty is excluded for:
- Category C: damaged, incomplete, for repair
- sold in "as is" condition
- User saw defects before auction
Display/Returned goods:
- if description contained information about that condition
- signs of use are acceptable
Mystery Box / Mystery Pallets - pursuant to Mystery Box Regulations
Goods explicitly marked as without warranty
Products sold with disclaimer "no claims right"
11.5 Attachment of Manufacturer's Warranty
- Possible manufacturer warranty (if exists) is realized under terms specified by manufacturer.
- Manufacturer warranty does not cover:
- normal wear
- damages resulting from use
- lack of maintenance
- user modifications
Warranty claims are directed directly to manufacturer, not to Organizer.
11.6 Claims Handling Procedure
- Deadline: Organizer will consider the claim within 14 business days of receipt.
- Possible resolutions:
- replacement with goods without defects (if available)
- repair (if technically possible)
- price reduction
- contract termination (refund)
Communication: Organizer will notify consumer of resolution by email.
§ 12. ORGANIZER'S LIABILITY
12.1 Limitation of Liability
The Organizer is not responsible for:
- User Errors:
- providing incorrect information (address, email)
- familiarity with auction description
Actions of Third Parties:
- carrier actions (transport damages)
- financial institutions (transfer errors)
- auction platform actions (Allegro, others)
System Availability Interruptions:
- technical work
- server failures
- force majeure
- in these cases auction is extended or repeated without additional costs
Indirect Losses:
- lost profits
- secondary costs
- moral harm (disappointment)
12.2 Limitation of Liability for B2B
- For B2B Users, Organizer's liability is contractually limited to the value of the paid price for the auction item.
- This does not apply to:
- compensation for intentionally wrongful acts
- violation of personal rights
- fraud
12.3 Responsibility for Item Description
- Organizer attaches great importance to accuracy of auction descriptions.
- In case of material error in description (e.g., error by order of magnitude) - Organizer invalidates auction and offers repetition without costs.
§ 13. ETHICAL RULES AND PROHIBITIONS
13.1 Prohibited Conduct
In particular, the following are prohibited:
- Artificial price increase (shill bidding):
- submitting fictitious bids to increase price
- using multiple accounts to bid against oneself
Collusion between Users:
- market division of auctions
- price fixing
Creation of multiple accounts in order to:
- bypass restrictions
- manipulate results
- avoid spending limits
Illegal communication:
- offensive content, hate speech
- threats
- extortion
- misleading content
Fraud:
- providing false information
- non-payment
- illegal transactions
13.2 Consequences of Breach
Breach of above rules may result in:
- Invalidation of auction results - without binding either party
- Account blocking - temporary or permanent
- Pursuing compensation claims by Organizer
- Reporting to law enforcement (in case of crimes)
§ 14. PERSONAL DATA AND PRIVACY PROTECTION
14.1 Data Controller

14.2 Data Processed
During auction participation, the following data is processed:
- first and last name (or company name)
- email address
- phone number
- delivery address
- auction and bid history
- payment information
14.3 Processing Purposes
Personal data is processed for:
- Conclusion and performance of contract (Article 6(1)(b) GDPR):
- account registration
- auction management
- contract performance
Compliance with legal obligations (Article 6(1)(c) GDPR):
- taxes, VAT
- accounting settlement
- financial reporting
Protection of Organizer's legitimate interests (Article 6(1)(f) GDPR):
- fraud prevention
- claims pursuit
- system security
Direct marketing (if consent given - Article 6(1)(a) GDPR):
- email about new auctions
- promotion notifications
- newsletters
14.4 Retention Period
- For contract purposes: for duration of relationship + 5 years (limitation period)
- For tax purposes: 6 years from end of tax year
- For marketing: until consent is withdrawn
- In disputed matters: during dispute + 3 years after resolution
14.5 User Rights
User has rights to:
- Access their data
- Correct data
- Delete data (right to be forgotten)
- Restrict processing
- Oppose processing
- Data portability to another organization
To exercise rights, User should send message to: admin@chinczyk.com with ID (PESEL for natural persons, NIP for companies).
14.6 Privacy Policy
Detailed information about data processing is contained in Privacy Policy available on shop website.
§ 15. CHANGES TO REGULATIONS AND FINAL PROVISIONS
15.1 Changes to Regulations
- Organizer reserves the right to change these Regulations for valid reasons:
- legal changes
- organizational changes in operations
- technical changes in auction system
- security
Changes become effective:
- immediately upon publication on shop website
- auctions started before change are subject to previous regulations
If change is materially unfavorable to consumer, notification will be sent by email.
15.2 Legal Proceedings and Mediation
- Mediation: Before pursuing legal action, we encourage mediation:
- User contacts by email: returns@chinczyk.com
- Organizer responds within 7 business days
- Parties reach agreement (if possible)
Court jurisdiction:
- for consumers: court competent for consumer's place of residence
- for B2B enterprises: court competent for Organizer's headquarters (Pniewo, Poland)
Applicable law: All auctions and contracts concluded as result of auctions are governed by Polish law.
15.3 Language of Communication
- Primary language is Polish.
- Correspondence in other languages (English, German, Ukrainian) is handled upon request, however jurisdiction remains Polish.
15.4 Entry into Force
- These Regulations become effective on January 24, 2026.
- They remain in force until their modification or repeal.
- Regulations are available on shop website and sent with each auction confirmation.

USER STATEMENT
By participating in an auction, User declares that:
- ✅ I have read and accept these Regulations
- ✅ I have read Mystery Box Regulations (if applicable)
